UI Outage Alerts Terms and Conditions

TERMS AND CONDITIONS GOVERNING USE OF THE UI ALERTS SERVICE OF THE UNITED ILLUMINATING COMPANY (“UI ALERTS”)

UI Alerts (the “Service” or “UI Alerts”) is a service provided by The United Illuminating Company (“UI”) that is designed to transmit messages alerting customers of (1) UI service outages, restoration time estimates, and restoration of service, (2) electricity usage information and (3) billing and price information related to your residence or business served by UI. Your use of the Service is subject to the Service Terms and Conditions set forth below (“Terms and Conditions”). These Terms and Conditions are subject to change from time to time, at the sole discretion of UI and without any notice to UI Alerts participants; a current version of the Terms and Conditions will be posted at here.

To receive UI Alerts by text message, your phone must be enabled for text messaging. Text messaging and data rates may apply. If you do not have a smart phone that links you to the website directly, you may need to use another computer to access the Terms and Conditions on the UI website before texting.

You have the ability to permanently discontinue your participation in UI Alerts at any time by texting "STOP" to 839-884.

TERMS AND CONDITIONS

1. Cost of Participation 

UI does not charge you a fee to participate in this Service. However, message and data rates from your phone service provider and/or Internet service provider may apply. You are responsible for the payment of any such fees. Check with your phone service provider and/or Internet service provider for details.

2. User Conduct 

You agree not to send or otherwise make available content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or contains hate speech. You acknowledge that UI may or may not pre-screen text message content you provide, but you acknowledge and agree that UI shall have the right, without obligation and in its sole discretion, to pre-screen, refuse, or remove any content you make available, including content that violates this section. You agree to provide true, accurate and complete information about yourself during the UI Alerts registration process, and to update this information promptly when it changes. If you provide any information that is untrue or inaccurate, not current, or incomplete, or if UI suspects that your information is untrue or inaccurate, not current, or incomplete, UI may, at UI’s sole discretion, suspend or terminate such UI Alert registration and/or access or refuse current or future access.

3. Confirmation, Opting Out and Discontinuing Use of UI Alerts or Asking Questions

You understand and agree that you will receive a confirmation text message for each text message sent to UI. To opt-out and discontinue UI Alerts, please send the keyword “STOP” to 839-884. If you experience any problems with opting out of UI Alerts, or if you need help or additional information related to UI Alerts, please text “HELP” to 839-884 or call Customer Service at 800.722.5584.

4. Security and Privacy 

It cannot be assured that information transmitted over the Internet and stored on computers connected to the Internet can be private or secure. UI shall endeavor to maintain the security and privacy of the information it receives in accordance with UI's Privacy Policy. A current version of UI’s Privacy Policy is located at https://www.uinet.com/wps/portal/uinet/nonnavigationfooter/privacypolicy/. The Privacy Policy is subject to change from time to time, at the sole discretion of UI and without any notice to UI Alerts participants. Notwithstanding the foregoing, UI makes no representation, guarantee or warranty that such information will be kept private or secure, and by utilizing UI Alerts you affirmatively agree to the disclaimer and limitation of liability provisions set forth in paragraphs 6 and 7 below. Each user shall be responsible for the use, security, and safeguarding of such user’s identification, password, UI account information, and other confidential information. UI shall have no responsibility or liability for damages resulting from the theft or unauthorized use of a user’s identification, password, UI account information or other confidential information (“User Confidential Information”). Each participant/user of UI Alerts acknowledges and agrees that UI may engage and use one or more outside vendors to host and/or maintain UI Alerts and that any such vendor may have access to the User Confidential Information of the participants/users of UI Alerts. Each participant/user expressly authorizes UI to provide each such vendor with access to such User Confidential Information in connection with the limited purpose of hosting and/or maintaining UI Alerts.

5. No Guarantee of Timely Delivery of Messaging

UI is not responsible for incomplete, lost, late, or misdirected messages, including (but not limited to) undelivered, incomplete or inaccurate messages resulting from any form of filtering or otherwise by your mobile carrier or service provider or any other third party supplier or entity.

6. Disclaimer of Warranties

You expressly understand and agree that your participation in the UI Alert Service and your reliance on the information available through the Service is at your sole risk. Text Alerts are provided on an "as is" and "as available" basis. UI and its parents, subsidiaries, affiliates, officers, agents, employees, partners, contractors, consultants, licensors, suppliers or their assignees and/or their successors in interest, expressly disclaim all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. UI and its subsidiaries, affiliates, officers, agents, employees, partners, contractors, consultants, licensors, and suppliers make no warranty that (a) UI Alerts will meet your requirements; (b) UI Alerts will be private, free from unauthorized access, uninterrupted, timely, secure, or error-free; or (c) the results that may be obtained from the use of UI Alerts will be accurate or reliable. 

You agree to hold UI and its directors, officers, employees and agents harmless from any and all losses or damages, including attorneys’ fees, that may arise, directly or indirectly, in whole or in part, from:

  • A non-delivery, delayed delivery, or the misdirected delivery of a UI Alert;
  • Inaccurate or incomplete content in a UI Alert; or
  • Your reliance on or use of the information provided in a UI Alert for any purpose.

IN NO EVENT SHALL UI BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH YOUR USE OF THE SERVICE OR WITH THE DELAY OR INABILITY TO USE THE SERVICE, OR FOR ANY INFORMATION OBTAINED THROUGH THE SERVICE OR OTHERWISE ARISING OUT OF THE UTILIZATION OF THE SERVICE, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, EVEN IF UI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

7. Limitation on Liability

To the fullest extent permitted by law, you expressly understand and agree that UI and/or its parents, subsidiaries, affiliates, officers, agents, employees, partners, contractors, consultants, licensors, agents, and suppliers, or their assignees and/or their successors in interest shall not be liable to you for any damages, costs or expenses incurred by you or for any direct, indirect, incidental, special, consequential or exemplary damages, including, but not limited to, attorney’s fees, damages for loss of profits, goodwill, use, data or other intangible losses, even if UI has been advised of the possibility of such damages, resulting from the use or the delay or inability to use UI Alerts, unauthorized access to or alteration of your transmissions or data, statements or conduct by anyone, including any third party, or any other matter relating to UI Alerts.

8. Events Beyond UI’s Control

UI will not be responsible for any loss resulting from an event over which it does not have direct control, including, but not limited to, failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, computer viruses, unauthorized access, theft, operator errors, severe weather, earthquakes, or natural disasters, strikes or other labor problems, wars or governmental restrictions. You acknowledge and agree that your receipt of any UI Alert may be delayed or prevented by factors affecting your phone service provider(s) or Internet service provider(s), and other factors outside UI’s reasonable control.

9. Suspension or Termination of Text Alerts

UI reserves the right, in its sole discretion, to change, cancel or suspend any or all of its Alerts, in whole or in part, or your participation therein, for any reason, or without (a) any notice to participants of UI Alerts, including you, or (b) any obligation of UI to offer or support any similar replacement program or service.

10. Applicable Law and Disputes

These Terms and Conditions and UI’s relationship with you regarding the UI Alerts are governed by the laws of the State of Connecticut, without regard to its conflict of laws principles. You and UI agree to submit to the exclusive jurisdiction of the courts of the State of Connecticut, and you and UI hereby waive any jurisdictional, venue or inconvenient forum objections to such courts.

11. Calls/Texts to Your Residence or Mobile Device

An auto-dialer and/or artificial or prerecorded message may be used to make calls or send text messages to you. You may receive UI Alerts even if your phone number is on the Federal or State “Do Not Call” registry. Your wireless carrier may charge fees for text messages, emails and calls to your mobile device. Message and data rates may apply. Text “STOP” to 839-884 to opt-out of our text messages or use the other opt-out methods listed below.

12. Opt-Out

You may elect at any time to no longer receive some or all UI Alerts by changing your preferences through your account on the UI website, by contacting a UI Customer Service Representative at 800.722.5584 or by texting “STOP” to 839-884. Your opt-out from text UI Alerts will be effective when you receive an opt-out confirmation. This opt-out message will remove your mobile device from all text messages from UI, even those you have enrolled in. If you no longer want to receive texts for a particular type of Alert message, then you must go to the UI website and unsubscribe that mobile device from that particular Alert. Please understand that it may take us a few days to process any UI Alert opt-out request. Even if you opt-out of receiving UI Alerts from us, we may still contact you in connection with your relationship, activities, transactions and communications with us.

13. Other 

These Terms and Conditions contain the entire agreement between you and UI regarding the use of the UI Alerts, and supersede all prior understandings related to use of UI Alerts. If any part of these Terms and Conditions is held invalid or unenforceable, that portion shall be construed in a manner consistent with applicable law to reflect, as nearly as possible, the original intentions of these Terms and Conditions, and the remaining portions shall remain in full force and effect.

Outage Alerts FAQs

    Text REG to 839-884 (TEXTUI) from your new mobile phone and follow the instructions to register your new phone number for the program.

    Once your move out has been completed, you will be automatically unregistered from TEXTUI for that property.

    If you want to un-register before you move, you may text STOP to 839-884 (TEXTUI). If you are registered for multiple accounts, you will be prompted to select the account number you wish to un-register. Once prompted for which notifications to stop, respond with ALL.

    If your new address is located in the UI service territory, please text REG and follow the instructions to re-register for TEXTUI with your new property.

    Text messaging keywords are short messages that enable you to communicate with our system quickly. Use any of these keywords to communicate with our outage alert system via text. If you text a keyword and decide not to continue with the process, texting any of the following keywords will debunk the previous process and start a new one corresponding to the newly selected keyword:

    REG Register for proactive communications

    NICK Give a nickname to a registered account-for instance, HOME, MOM, COTTAGE

    OUT Report an outage

    PAUSE Pause communications from UI

    STAT Request the status of an outage

    RESUME Unpause communications from UI

    SUB Subscribe to outage alerts or storm alerts

    HELP Provides a list of keywords, a link to the UI website for more information, and a customer care number

    STOP Unsubscribe from outage notifications or storm notifications 

    While UI does not charge for text messages, standard messaging and data rates may apply based on your carrier and mobile phone plan. TEXTUI works with most major mobile phone carriers.

    Simply enter 839-884 and key in the word STOP. You will receive a message asking you to choose which notifications to stop.  Respond with the ALL option to completely un-register from the program and no longer receive any notifications. Once you have unregistered, you will receive a confirmation text message. To re-register, enter 839-884 and key in REG.

    TEXTUI is supported by major mobile phone carriers. However, there are some that are not currently supported. If you attempt to register and your message fails, please ensure that your carrier supports texting to short codes before trying again.

    Yes, you can register more than one mobile phone number for a single property. Text REG to 839-884 (TEXTUI) from each mobile phone and register using that Account Number. Each mobile phone will receive outage updates.

    If a connection error occurs:  UI: "We are experiencing technical difficulties. Please try again later or call 800.722.5584 to report your outage."

    If a user error occurs:  UI: "We're sorry, but the account number and/or the last four digits of your SSN/Tax ID did not match the records in our database. Please try again."

    There are a few different scenarios that can cause a user not to receive a registration text message.

    Unsupported mobile carrier: At this time, TEXTUI is supported by major mobile phone carriers and most others. We are continually looking for ways to enhance TEXTUI and anticipate adding more mobile carriers in the future.

    Text messaging blocked: If your mobile carrier is supported, you may have a setting on your mobile phone's account that is blocking incoming text messages. Please contact your mobile provider to ensure that text messaging is enabled.

    Short code messaging blocked: If your mobile carrier is supported, you may have a setting turned on for your phone's account that is blocking short code messages. Short code messages are any messages that come from a short number such as 839-884 (TEXTUI). Please contact your mobile carrier to change your account setting to allow short code messaging.

    The frequency of text messages received varies based on outages affecting UI service territory.

    No action is required if you switch to a mobile phone carrier that is supported by TEXTUI. Your phone number will still be registered, and the service will still be available to you. Please note that standard message and data rates may apply through your new carrier.

    While TEXTUI is supported by most major mobile phone carriers, there are some that are not currently supported. If you attempt to register and your message fails, please ensure that your carrier supports texting to short codes and that text messaging is enabled before trying again.

    To report an outage, please text OUT to 839-884

    You can request outage status on demand by texting STAT to 839-884. The SMS message you receive depends on the current situation:

    If you are not registered yet:

    UI: Register your account before using this feature. Reply REG to begin

    If UI is not aware of the outage or if it is a partial power situation:

    UI: We are not aware of an outage in your area. Please text OUT to report an outage. For status on a partial power report, please call our Customer Care Center at 800.722.5584.

    If UI is aware of the outage but there is no estimated recovery time (ERT) for the outage:

    UI: According to our records, [YOUR ADDRESS] is without power. We are working hard to restore your service. Text STAT at a later time to receive updates about your outage.

    Yes, you may register multiple properties to one cell phone number. For each property, text REG to 839-884 (TEXTUI). You will receive a text message asking for the 14-digit account number, which is located on your electric bill. Next, you will receive a text message asking for the last 4 digits of the Social Security Number of the customer.  Once you have provided all required information, you will receive a registration confirmation text. We will then text you a list of your registered accounts to select from when you text OUT to report your outage.

    When you text OUT to 839-884 (TEXTUI) to get outage updates, you will receive storm preparation, storm impact, and storm updates.

    To register for Text UI, send a text message to 839-884 (TEXTUI).  You will be prompted to reply REG to register.

    Registration requires your 14-digit UI account number and last four digits of your Social Security Number or Tax ID Number.

    If you do not have a Social Security Number or Tax ID Number on file with UI, you will not be able to use the quick registration process.  You will have to sign up and manage your preferences through My Account.

    You will then be prompted to confirm that you want to report an outage:

    UI: "Are you sure you want to report an outage? Check your circuit breakers and text Y to report an outage at (location)."

    TEXTUI is a notification service that enables customers to receive outage updates via text message. The program is available without charge to all customers within the UI service territory, but please note that standard message and data rates may apply through your carrier.

    You can request the status of an outage by going to the UI homepage, selecting the OUTAGE ALERTS link at the bottom of the page, and logging in (as shown in the Reporting Outage steps). You may also log in through My Account and select Outages:


    If UI is not aware of the outage or if it is a partial loss of power, you will see the following message:

    Outage Status:

    We are not aware of an outage in your area. To report an outage, please follow the outage reporting process below or text OUT to 839-884. For status on a partial power report, please call our Customer Care Center at 855.784.3637.

     

    If UI is aware of the outage but there is no Estimated Restoration Time (ERT) for the outage:

    Outage Status:

    Our records indicate that an outage may be affecting service at <<Street address>><<town>>. We are to restore service in  your area.

    Check back or text STAT to 839-884(TEXTUI) to receive outage updates. If you wish to provide us with more information, please follow the process below.


    If UI is aware of the outage and there is an ERT for the outage:

    Outage Status:

    Our records indicate that an outage may be affecting service at <<street address>><<town>>. We are working to restore service in your area.

    Your estimated restoration time is between<<Month Date Year>> at <<Time AM?PM>> and <<Month Date Year>> at <<Time AM/PM>>.
